REGULATION OF PRÊMIO INVESTIDOR PROFISSIONAL DE ARTE – PIPA
1. PRESENTATION
1.1) Initiative of the Investidor Profisisonal Gestão de Recurso, coordinated by the Instituto Investidor Profissional in partnership with the Museum of Modern Art in Rio de Janeiro – MAM, Prêmio Investidor Porfissional de Arte – PIPA is designed to promote the Art, Artists in Brazil and the city of Rio de Janeiro, encouraging domestic production of contemporary art.
1.2) The Prêmio Investidor Profissional de Arte, hereinafter simply PIPA, aims to select an artist by the Jury Award and an artist by the Popular Jury, among the four (4) artists finalists, as defined in this Regulation.
1.3) The execution of PIPA is in responsibility of the INSTITUTO INVESTIDOR PROFISSIONAL, based in the City and State of Rio de Janeiro, at Ataulfo de Paiva avenue # 255, 9th floor, Leblon, CNPJ/MF # 11.760.852/0001-01, hereafter simply called INSTITUTO IP and the MUSEUM OF MODERN ART OF RIO DE JANEIRO, based in the City and State of Rio de Janeiro, at Infante Dom Henrique avenue # 85, Gloria, CNPJ/MF # 33.467.002/0001-44, hereafter simply called MAM.
1.4) For purposes of this Regulation, the following definitions are taken:
1.4.1) Council of PIPA: senior management council of PIPA consisting of 5 to 7 members, being two representatives of the IP, two representatives of MAM and the other invited among knowledgeable professionals, Brazilian or foreign, that work with contemporary art, having the following powers and duties:
(i) Contribute to the credibility and visibility of PIPA, coordinating its management and execution.
(ii) Ensure compliance with the rules of PIPA, especially this Regulation.
(iii) Coordinate the process of selecting Indicators and members of the Jury Award.
(iv) Discuss and propose possible changes in the PIPA’s Regulation.
(v) Decide, ultimately, about all the possible omissions and on all questions that may be presented in connection with this Regulation and PIPA.
1.4.2) Indicators: A set of 30 (thirty) to 50 (fifty) renowned professionals, Brazilian or foreign, that work with contemporary art, invited by the Council of PIPA, which each one will indicate up to five names of Brazilian new artists to participate in the PIPA.
1.4.3) Award Jury: group of 5 to 7 members, invited by the Council of PIPA, at least one representative from established artists, one of collectors, one of gallery owners and one of the curators and art critics, who will select the winner of PIPA among the four finalists who will be selected by the Council of PIPA from the indications of Indicators.
1.4.4) Popular Jury: public visiting the exhibition of PIPA at MAM who will have the right to vote for their favorite artist.
1.4.5) Executive Secretary of PIPA: is the Director of the INTITUTO IP, who will be in charge of coordinate the production of PIPA and assists all its organs and councils.
2. SYSTEMATIC AND STRUCTURE OF THE PIPA
2.1) Participation in the PIPA is free and will only be valid for purposes of competition for prizes. 2.2) Indicators of PIPA and the Award Jury themselves may not be accepted as participating artists. 2.3) The selection of artists participating in the PIPA will be given as follows:
2.3.1) Each indicator will indicates up to five artists for the Council of PIPA based on the following criteria:
(i) There should be an artist, but not yet renowned, being at the discretion of its own Indicator to evaluate and define what it considers “not renowned”.
(ii) The artist’s production since early 2009.
2.3.2) The Council of PIPA will select from among those indicated, four finalists, taking as one of the criterion the number of indications received.
2.3.3) Will be provided time for the four finalists to prepare works for exhibition to be held at MAM.
2.3.4) During the exhibition, the Award Jury will evaluate the entire portfolio of four finalists, including works produced for the exhibition, and will select the winner of PIPA.
2.3.5) In parallel, during the exhibition at MAM, the visitors can vote on their favorite artist and who obtains the most votes will receive the Popular Jury award.
2.4) The artists at any stage, may compete with works in any media or format, such as painting, photo, sculpture, urban art, video, installation, online, etc.
2.5) The PIPA will be released via its own website and on Investidor Profissional’s and MAM’s websites.
2.6) The participants are the sole responsible by the accuracy of the information provided.
2.7) The information provided in the registration of participants will be used for sending data, and other important communications that are deemed necessary by the Council of PIPA. The absence of this data, or the impossibility of communication by the organizers will be the sole responsibility of the participant.
2.8) The decisions of the Council of PIPA and the Award Jury are final and sovereign and there will no possible revisions.
2.9) The winners of the Award Jury and the Popular Jury, which may be the same finalist will be announced at the awards event to be held at MAM.
2.10) Only the four finalists will be entitled to receive the amount of $ 3,000.00 (three thousand reais) for the preparation of the works for the exhibition which will take place at MAM, as well as to cover all expenses for their own participation in it.
2.11) Each one of the four finalists agrees to donate one of the works that compose the PIPA exposure to MAM, and the winner(s) of the Award Jury and the Popular Jury shall donate furthermore, a second work for the INTITUTO IP.
2.11.1) MAM has the power to indicate which works will be donated to itself among those that compose PIPA’s exhibition, and MAM will have preference regarding the choice of INTITUTO IP.
2.12) The participants intend to develop original works. The artist participant is solely responsible for authorship of the work and will be legally responsible even in the case of plagiarism or any other question that relates to the veracity of the authorship informed.
2.13) INTITUTO IP and MAM are exempt, with the express agreement of the participants, from any liability in case of technical problems which may, temporarily or permanently, modify or prevent the disclosure of any content of PIPA.
2.14) The PIPA was purely cultural, without any kind of luck, or bond with the purchase of products or services and therefore not dependent on any official agency authorization, pursuant to Law 5.768/71 and other applicable legal provisions.
2.15) Every participating artist must sign the authorization for participation, and the four finalists must sign, too, specific contract for participation in the exhibition of PIPA and the subsequent donation of one or two of his/her works.
2.16) INTITUTO IP and MAM reserve the right at its sole discretion, to change the terms of this Regulation, informing participants in advance, by notices on the website of PIPA, always binding by the legality and respect for the participants.
3. SCHEDULE
3.1) The PIPA will have the following schedule:
04/09/2010 – Launch of PIPA and its Regulation
04/14/2010 – Press conference at the Pinacoteca do Estado de São Paulo
04/30/2010 – Formation of the Council of PIPA and definition of the criteria for inclusion of the indicated in the catalog of PIPA
05/31/2010 – Announcement of list of Indicators
06/15/2010 – Deadline for the receipt of nominations by the Indicators
07/15/2010 – Announcement of PIPA’s finalists
09/25/2010 – Opening of exhibition of PIPA at MAM and announcement of the names of the members of the Award Jury
10/28/2010 – Award Ceremony
11/14/2010 – End of exposure of PIPA at MAM
4. AWARDS
4.1) The PIPA’s award shall consist of:
4.1.1) To the indicated that meet the criteria set by the Council of PIPA: insert of his/her name and picture of one of his/her works in the catalog of PIPA.
4.1.2) For the finalists that are not covered either by the Award Jury and not by the Popular Jury: certificate of participation and inclusion of his/her name, brief curriculum and image of one of his/her works in the catalog of PIPA.
4.1.3) For the winner of the Popular Jury: trophy, inclusion of his/her name, brief curriculum and images of his/her works in the catalog of PIPA, and R$ 20.000,00 (twenty thousand reais).
4.1.4) For the winner of the Award Jury: trophy, inclusion of his/her name, brief curriculum, and images of his/her works in the catalog of PIPA, and R$ 100.000,00 (one hundred thousand reais), of which R$ 75.000,00 (seventy-five thousand reais) in cash and R$ 25.000,00 (twenty-five thousand reais) for use in the winner’s participation in international artist residency program.
4.2) If the winner of the Popular Jury and Award Jury are the same artist, it will accumulate all the prizes.
4.3) The winner of the Award Jury must commit to use the resources on the international art residency in accordance with what is set by the Council of PIPA, on pain of losing the prize.
4.4) The finalist(s) who not accomplish the requirements of this Regulation will be disqualified and will lose the awards.
4.5) The sending of the images that will comprise the catalog of PIPA shall be in the sole and exclusive responsibility of the indicated themselves, which should refer the file to the image in jpeg format with resolution of 300 dpi or according to the request of the publisher.
4.6) The awards are individual and nontransferable.
4.7) The winner(s) will be advised of the outcome at the award ceremony.
4.8) The participants of PIPA, including the winners, assume full and sole responsibility in respect of all and any claims by third parties who were disadvantaged by their participation.
4.9) The participants of PIPA, including the winners, allow the use of their names, pictures and voice, free of charge in all PIPA’s publishing.
4.10) Participation in the PIPA implies full agreement with this Regulation.
5. GENERAL
5.1) Will be disqualified and excluded from the PIPA:
(i) Those who do not fit in the categories of membership.
(ii) Work of authorship of third parties.
(iii) Participants who commit any kind of fraud.
5.2) The selection and judging criteria are set directly by the Council of PIPA and the Award Jury, whose decisions are final and sovereign and there will no possible revisions.
5.3) Loss of entitlement to the prize will occur if the winner is unable to receive the same. In this case the right to the prize will be transferred to the participant ranked ahead.
5.4) Any question, dispute or situation not covered by this Regulation shall be assessed and decided by the Council of PIPA, whose decision is sovereign and unappealable.
